就李荣浩公开表演《路一直都在》,做出以下说明。 <\/span><\/p>\n

有网友称:2013年《行走的力量》音乐分享会是公益活动,结合活动性质,李荣浩现场表演我的作品《路一直都在》,无须作者许可。 <\/span><\/p>\n

1.关于无须作者许可的法律规定 <\/span><\/p>\n

《中华人民共和国著作权法》第二十四条规定: <\/span><\/p>\n

“在下列情况下使用作品,可以不经著作权人许可,不向其支付报酬,但应当指明作者姓名或者名称、作品名称,并且不得影响该作品的正常使用,也不得不合理地损害著作权人的合法权益: <\/span><\/p>\n

(九)免费表演已经发表的作品,该表演未向公众收取费用,也未向表演者支付报酬,且不以营利为目的;” <\/span><\/p>\n

法律明确了无须作者授权的前提,必须满足“不以营利为目的”,但法律实践中:公益活动≠没有营利。 <\/span><\/p>\n

所谓公益活动可以未经许可表演他人已发表作品,不具有法律依据。 <\/span><\/p>\n

2.关于新法与旧法 <\/span><\/p>\n

有人说,2013年李荣浩表演《路一直都在》时,新著作权法还未实施,应按照2010年颁布的旧著作权法,因为旧法没有“非营利”的表述,只要活动未售票,依然可以不经作者许可,使用他人已经发表的作品。 <\/span><\/p>\n

首先:“什么情况下可以不经作者许可,公开表演已发表的作品”,法律认定的条件及要素一直很严格,新法旧法针对这一条款,没有实质变化。 <\/span><\/p>\n

其次:卖不卖票,不是活动性质认定的唯一标准。 <\/span><\/p>\n

不卖票≠可以未经许可,使用他人音乐作品。 <\/span><\/p>\n

3.关于演出活动性质 <\/span><\/p>\n

公益活动或非公益活动,通常都是活动名称,法律不以名称认定活动性质。只要符合法律规定,即便不是公益活动,也可以不用获得作者许可,表演已发表的音乐作品,这是其一。 <\/span><\/p>\n

其二,但凡表演者或表演组织者没有取得作者许可,公开表演了他人作品,这样的活动性质必须一目了然、清清楚楚,活动有没有商业背书?符合不符合法律规定的情形等等,要随时接受作者监督及追溯。 <\/span><\/p>\n

从已掌握的多份证据看,2013年《行走的力量》音乐分享会属于商业活动,不符合“未经许可就能使用他人音乐作品”的法律规定。 <\/span><\/p>\n

4.关于 《路一直都在》歌词版权 <\/span><\/p>\n

2023年11月,北京互联网法院作出了以下认定: <\/span><\/p>\n

“本院认定,环球音乐公司提交授权链条不完整,不能仅凭没有原告授权的案外公司的单方授权即认为其获得了合法授权。” <\/span><\/p>\n

二审维持原判,判定环球公司侵权。 <\/span><\/p>\n

环球音乐公司在法庭上自述,环球音乐公司拥有的《路一直都在》词版权,由案外公司转授权给环球音乐公司,环球音乐公司又将《路一直都在》转授权给音乐平台及其他使用方。 <\/span><\/p>\n

环球音乐在未获得我许可情况下,(冒充我的版权代理公司)对外转授权,侵吞版权费,数年。 <\/span><\/p>\n

2021年之前,从环球公司取得《路一直都在》授权的使用方,因未尽到合理审查义务,全部被法院认定为侵权。 <\/span><\/p>\n

杭州法院、四川法院、北京法院均认定,我是《路一直都在》词作者及权利人。 <\/span><\/p>\n

5.关于许可情况说明 <\/span><\/p>\n

取证过程中,我专门致电中国音乐著作权协会,询问《行走的力量》活动主办方是否向音著协申请过作品许可?2026年4月13日下午我亲自前往音著协,了解情况。 <\/span><\/p>\n

在音著协了解到以下情况:北京东申童画(北京)文化传播有限公司,曾以活动名【“The way 路”行走的力量陈坤和他的朋友音乐分享会】向协会申请表演许可,申请作品包括《路一直都在》,在申请表格落款处,许可方和被许可方均未填写日期,目前无法判断表演许可是不是在演出前申请的。 <\/span><\/p>\n

音著协称:2015年汇出的一笔钱,是2013年李荣浩现场表演《路一直都在》的许可费,金额180块4角8分。 <\/span><\/p>\n

6. 关于音著协的许可是否合法? <\/span><\/p>\n

先讲观点:我认为不合法。 <\/span><\/p>\n

首先,自2021年《路一直都在》侵权案发生以来,环球公司称,2008年—2021年,环球持续拥有《路一直都在》词版权,为证明其自述,环球向我出示了代码AAKV的环球财务文件。 <\/span><\/p>\n

其次,2021年起我诉环球时发现:环球公司通过台湾省中华音乐著作权协会【简称MUST】打包认领了《路一直都在》等我创作的歌词版权,并将《路一直都在》转授权给协会,由协会继续对外许可。 <\/span><\/p>\n

同年,音著协内部资料库显示:2008年—2021年,《路一直都在》歌词一栏,作词:吴向飞,版权归属环球公司,歌词OP\/SP分别是环球不同地区的公司。多年来,音著协依据台湾省中华音乐著作权协会【MUST】未经核实的作品版权登记,认定环球是《路一直都在》词权利人,自2008年开始,向环球公司支付《路一直都在》等作品使用费,超过331笔。 <\/span><\/p>\n

结合2021年环球发给我的微信、邮件、环球法庭自述,以及环球向法院提交的证据、数百页版税报表、音著协后台资料等等,以上证据均指向:自2008年开始,音著协代表环球公司对外发放《路一直都在》歌词许可。 <\/span><\/p>\n

7.关于审查、登记和许可 <\/span><\/p>\n

音著协是我自1999年发表作品以来最信任的合作伙伴,但随着《路一直都在》诉讼的深入调查,我发现音著协对外许可的确存在一些问题。 <\/span><\/p>\n

音著协说,根据内部登记的著作权占比,2013年《路一直都在》是以我的名义对外许可的,对此,我不认可。 <\/span><\/p>\n

首先,音著协在2008年开始就将《路一直都在》以环球名义对外许可。音著协提出的2013年词版权有更迭,依据的是内部版税分配记录,但版税分配记录让人看了不知说什么好。比如:《路一直都在》2014年的许可费显示词权利人是环球(我0著作权占比),一会又出现一笔费用(我和环球平均分著作权占比),一会儿又出现一笔费用,词权利人是吴向飞(环球0著作权占比)。 <\/span><\/p>\n

也就是说,究竟谁是《路一直都在》歌词权利人?从使用费分配占比看,在音著协内部,大家都是权利人。其乐融融。 <\/span><\/p>\n

那一年,音著协一会儿说代表环球许可,一会儿说代表作者许可。权利人变来变去,扑朔迷离。 <\/span><\/p>\n

实际从这些年诉讼中看到,很多作者的权利,被版权公司认走,作者是毫不知情的,越知名的作者,作品被认走的概率越高。协会如果没有合理有效的的审查手段,等于加入协会的作者就变成了版权公司的输血包。你是某首作品的曲作者,你有100%作曲权利,当版权公司把你的作曲权利认走后,你是不知情的,因为在音著协即使版权公司认走了作者的权利,作者还会收到一半的钱,这是协会的福利,但它带来的,是让作者误以为权利还在自己手上,实际上收入损失了一半。一晃就过去很多年。 <\/span><\/p>\n

当权属不清时,每一次对外许可,都有可能不断侵害作者的权益,将作者的收入流向版权公司,增加使用方侵权风险,我想,这也违背了词曲作者加入音著协的初衷。 <\/span><\/p>\n

作为国内唯一的音乐著作权集体管理组织,音著协让很多作者从收不到钱到有钱收,30年来成绩有目共睹,但是,版权公司随意将作者的作品认领到公司名下,以及版权交迭中的盲区,暴露的是音著协对非作者会员主张权利缺乏审查。如果音著协代表的会员不是作品权利人,音著协发出的授权许可,合不合法?获得许可的被授权人及表演者,应该承担什么样的侵权责任? <\/span><\/p>\n

看着这些年一笔一笔创作收入,通过音著协流入环球公司,全当为认知买单了。 <\/span><\/p>\n

8.给所有表演者的一点建议 <\/span><\/p>\n

无论是否取得了所谓授权,只要是词曲作者前来询问,演出方或表演者都有义务将取得表演许可的过程,告知作者。《中华人民共和国著作权法》规定:作者自作品创作之日起,享有著作权。接受作者质疑和监督,是一件再正常不过的事,这是法律赋予作者的权利。 <\/span><\/p>\n

现经调查及全面取证,李荣浩在2013年3月8日的一场商业赞助活动中公开表演了我创作的《路一直都在》,对音著协授权的表演许可,我不认可。至于180块4角8分,算是我几年前退出音著协的纪念吧。 <\/span><\/p>\n
